Translation Coordination Services Agreement
Required Customer Acknowledgment Before Checkout
By selecting Translation Coordination Services, submitting documents, uploading files, making payment, or asking Apostille MA Service to begin work, I agree to the terms below.
I understand that this agreement applies only to translation coordination services connected with my order.
1. Apostille MA Service Does Not Provide Translation Services
I understand and agree that Ansspvt LLC DBA Apostille MA Service does not provide translation services directly.
Apostille MA Service does not translate documents, review translated text for accuracy, certify translation accuracy, verify the meaning of translated words, or confirm that a translated document is legally sufficient for any country, court, school, employer, agency, embassy, consulate, or receiving party.
All translation work is completed by an independent third-party translation provider.
2. Limited Role of Apostille MA Service
I understand that Apostille MA Service’s role is limited to administrative coordination.
This may include:
a. receiving my documents,
b. sending my documents to a third-party translation provider,
c. receiving the translated document,
d. receiving a translator-issued Certificate of Accuracy, Translator’s Affidavit, or similar statement,
e. coordinating notarization of a translator’s signature if needed,
f. using the translated document for apostille, authentication, legalization, mailing, shipping, or courier handling if requested, and
g. giving me order updates.
I understand that this coordination service does not make Apostille MA Service the translator.
3. Independent Third-Party Translation Provider
I understand that the translation provider is independent from Apostille MA Service.
The translation provider is solely responsible for:
a. translation accuracy,
b. completeness of the translation,
c. spelling of names,
d. dates, numbers, and document details,
e. format and layout,
f. language choice,
g. grammar,
h. professional translation standards,
i. Certificate of Accuracy, and
j. Translator’s Affidavit or similar statement.
I understand that any issue about translation quality, wording, errors, omissions, formatting, or accuracy must be directed to the translation provider.
Apostille MA Service may help communicate with the translation provider as a courtesy, but this does not make Apostille MA Service responsible for the translation.
4. No Certification of Translation Accuracy
I understand that Apostille MA Service does not certify, verify, approve, or guarantee the accuracy of any translation.
Any Certificate of Accuracy, Translator’s Affidavit, or similar document is issued by the third-party translation provider, not by Apostille MA Service.
I agree not to claim, suggest, or represent that Apostille MA Service translated the document or certified the accuracy of the translation.
5. Notarization of Translator Signature
If a translator’s affidavit, Certificate of Accuracy, or similar document is notarized, I understand that the notarization applies only to the identity and signature of the person signing that affidavit or certificate.
The notarization does not mean that Apostille MA Service:
a. translated the document,
b. reviewed the translated text,
c. certified the translation,
d. verified the accuracy of the translation,
e. approved the wording,
f. confirmed the legal effect of the translation, or
g. guaranteed acceptance by any receiving party.
I understand that a notarial act is separate from translation accuracy.
6. No Legal, Immigration, or Foreign Law Advice
I understand that Apostille MA Service is not a law firm and does not provide legal advice.
Apostille MA Service does not advise me about:
a. whether a translation is legally sufficient,
b. whether a translation will satisfy immigration rules,
c. whether a translation will satisfy court rules,
d. whether a translation will satisfy school or employer rules,
e. whether a translation will satisfy embassy or consulate rules,
f. whether a translation will satisfy foreign government requirements, or
g. whether a translation will be accepted in another country.
I am responsible for checking the exact translation requirements with the receiving party before placing my order.
7. Client Responsibility to Review Translation
I agree that I am responsible for reviewing the completed translation before using it.
I must check:
a. names,
b. dates,
c. spelling,
d. addresses,
e. passport numbers,
f. ID numbers,
g. birth dates,
h. document numbers,
i. seals and stamps,
j. document titles,
k. formatting,
l. page count, and
m. any special wording required by the receiving party.
If I do not read or understand the translated language, I am responsible for having the translation reviewed by someone who does.
8. Receiving Party Requirements
I understand that each receiving party may have its own rules.
A receiving party may include:
a. a foreign government,
b. an embassy,
c. a consulate,
d. a court,
e. an immigration office,
f. a school,
g. an employer,
h. a licensing board,
i. a bank,
j. a business authority,
k. a marriage office,
l. a citizenship office, or
m. any other person or agency reviewing the document.
I understand that Apostille MA Service does not control these requirements and does not guarantee that the translation will meet them.
9. No Guarantee of Acceptance
I understand and agree that Apostille MA Service does not guarantee that any translated document will be accepted by any government office, Secretary of State office, federal agency, embassy, consulate, court, school, employer, immigration office, foreign authority, or receiving party.
A translated document may be rejected for reasons outside Apostille MA Service’s control, including:
a. receiving-party rules,
b. destination country rules,
c. formatting requirements,
d. language requirements,
e. certification requirements,
f. affidavit requirements,
g. notarization requirements,
h. apostille or legalization requirements,
i. old or damaged original documents,
j. unclear scans or photos,
k. missing pages,
l. incorrect client information, or
m. changes in government or agency policy.
10. Translation Fees and Refunds
I understand that translation fees are non-refundable once the translation request has been submitted to the third-party translation provider.
If I cancel before the translation request is submitted, Apostille MA Service may deduct:
a. a minimum 10% administrative fee,
b. payment processing fees,
c. document review fees,
d. intake and setup fees,
e. communication and coordination time, and
f. any other cost already incurred.
Once the translation request is submitted to the third-party provider, no refund will be issued for the translation portion of the order.
No refund will be issued because:
a. I changed my mind,
b. I no longer need the translation,
c. I submitted the wrong document,
d. I gave incorrect instructions,
e. the receiving party rejects the translation,
f. the translation takes longer than expected,
g. the receiving party asks for different wording,
h. the receiving party requires a different format, or
i. the receiving party changes its requirements.
11. Translation Timing Is Only an Estimate
I understand that any translation turnaround time is an estimate only.
Rush, same-day, next-day, expedited, or estimated delivery times are not guarantees unless Apostille MA Service gives a separate written guarantee.
Apostille MA Service is not responsible for missed deadlines, travel dates, immigration dates, school deadlines, court deadlines, business deadlines, appointment dates, or other losses caused by translation timing.
12. Document Quality and Upload Responsibility
I understand that translation quality may depend on the quality of the document I provide.
I am responsible for providing clear, complete, readable copies or originals.
Apostille MA Service and the translation provider are not responsible for errors, delays, or rejection caused by:
a. blurry scans,
b. cropped photos,
c. missing pages,
d. handwriting that is hard to read,
e. damaged documents,
f. poor image quality,
g. wrong file uploads,
h. incomplete documents, or
i. documents sent in the wrong order.
13. Corrections and Revisions
If I believe there is an error in the translation, I must notify Apostille MA Service in writing as soon as possible.
Correction requests must include:
a. the order number,
b. the specific word or section at issue,
c. the requested correction, and
d. the reason for the correction.
Apostille MA Service may forward the request to the translation provider.
I understand that correction requests are not guaranteed. The translation provider may accept, reject, or revise the request based on its own review.
Additional fees may apply if the correction is caused by incomplete client information, unclear documents, changed instructions, new receiving-party requirements, or a client-requested wording change.
14. Apostille, Authentication, or Legalization After Translation
If I request apostille, authentication, legalization, notarization coordination, shipping, or courier service after translation, I understand that those services are separate from translation.
I understand that a translated document may need additional steps before it can be used, including a translator’s affidavit, notarization, apostille, authentication, embassy legalization, consulate legalization, or other receiving-party requirement.
Apostille MA Service does not guarantee that any translation or related document will qualify for apostille, authentication, legalization, or acceptance.
15. Shipping and Delivery
If translated documents are shipped, mailed, or sent by courier, I understand that shipping and delivery are handled by third-party carriers.
Apostille MA Service is not responsible for carrier delay, loss, damage, misdelivery, customs delay, incorrect address, returned package, or delivery refusal.
I am responsible for giving a correct and complete delivery address.
16. Client Authorization
I authorize Apostille MA Service to send my documents and personal information to a third-party translation provider for the purpose of completing my translation coordination request.
I also authorize Apostille MA Service to share my documents and information with notaries, couriers, shipping carriers, government offices, embassies, consulates, or vendors when needed to complete services connected to my order.
17. Privacy and Document Handling
I understand that translation coordination requires my documents and personal information to be shared with a third-party translation provider.
Apostille MA Service will use reasonable care when handling my documents. However, I understand that Apostille MA Service cannot control the internal policies, security practices, or systems of independent third-party translation providers, carriers, government offices, embassies, consulates, or vendors.
18. Limitation of Liability
To the fullest extent allowed by Massachusetts law, I agree that Apostille MA Service is not responsible for any claim, loss, damage, delay, rejection, cost, or consequence related to the translation or use of the translated document.
This includes, but is not limited to:
a. translation errors,
b. translation omissions,
c. formatting issues,
d. spelling issues,
e. grammar issues,
f. incorrect dates or numbers,
g. rejection by a receiving party,
h. delay by the translation provider,
i. delay by a government office,
j. delay by an embassy or consulate,
k. delay by a courier,
l. missed deadlines,
m. missed travel,
n. immigration issues,
o. school issues,
p. court issues,
q. business losses,
r. lost income,
s. lost opportunity,
t. emotional distress, or
u. any indirect, incidental, special, or consequential damages.
If Apostille MA Service is found responsible for any issue connected to translation coordination, I agree that Apostille MA Service’s total liability will not exceed the amount I paid directly to Apostille MA Service for the translation coordination portion of the order.
This limit does not apply to claims that cannot be limited under Massachusetts law.
19. Indemnification
I agree to defend, indemnify, and hold harmless Apostille MA Service, its owners, employees, contractors, agents, vendors, and service providers from any claim, demand, loss, cost, damage, charge, fee, penalty, expense, or attorney’s fee related to:
a. the translation,
b. my use of the translation,
c. my documents,
d. incorrect information I provided,
e. missing or unclear documents,
f. receiving-party rejection,
g. destination country requirements,
h. third-party provider acts or omissions,
i. courier or shipping issues,
j. my failure to review the translation, or
k. my failure to confirm receiving-party requirements.
20. No Waiver of Non-Waivable Consumer Rights
Nothing in this agreement waives any right that cannot be waived under Massachusetts law.
This agreement is intended to clearly disclose the role of Apostille MA Service, the role of the third-party translation provider, the refund limits, the risk of rejection, and the customer’s responsibility before the customer selects translation coordination.
21. Governing Law
This agreement is governed by the laws of the Commonwealth of Massachusetts.
Any dispute related to this translation coordination service shall be handled under Massachusetts law, unless a different law is required by a court or statute.
