IMPORTANT LEGAL NOTICE

By using this website, submitting an online order, uploading documents, checking any acknowledgment box, making payment, communicating with Apostille MA Service about a service request, or allowing Apostille MA Service to begin work, you agree to these Waiver, Authorization, and Service Terms.

This is a legally binding agreement. You should review it before placing an order. If you do not understand any part of these terms, you should speak with your own attorney before using our services.

Apostille MA Service is not a law firm, does not provide legal advice, does not provide immigration advice, does not interpret foreign law, and does not guarantee that any document will be accepted by any government office, foreign country, embassy, consulate, school, employer, court, agency, or receiving party.

These terms are written to allocate risk clearly, disclose fees and limits clearly, and avoid deceptive or hidden terms under Massachusetts consumer protection law, including M.G.L. c. 93A and related Massachusetts consumer protection regulations. The consumer protection materials you attached list M.G.L. c. 93A and 940 CMR 38.00 as key Massachusetts consumer protection authorities, including rules about clear fee disclosure.

1. Agreement to Terms

These terms apply to all users, customers, clients, visitors, and persons who submit, upload, pay for, or request any service through Apostille MA Service.

By placing an order, uploading documents, making payment, checking an acknowledgment box, or requesting that work begin, you agree that:

a. you have read these terms,
b. you understand these terms,
c. you accept these terms,
d. you authorize Apostille MA Service to handle and process your documents, and
e. you agree that your online acceptance, payment, uploaded documents, IP address, timestamp, order record, and related electronic records may be used as proof of acceptance.

2. Limited Scope of Service

Apostille MA Service provides private administrative document services only.

Our services may include:

a. basic document intake,
b. basic administrative review,
c. document handling,
d. courier coordination,
e. shipping coordination,
f. apostille submission,
g. authentication submission,
h. embassy or consulate legalization coordination,
i. certified copy or vital record assistance,
j. translation coordination,
k. pickup and delivery coordination, and
l. return mailing or shipping.

We do not act as:

a. a lawyer,
b. a law firm,
c. a government agency,
d. a foreign government office,
e. an embassy,
f. a consulate,
g. a court,
h. an immigration consultant,
i. a school,
j. an employer,
k. a registrar,
l. a legal representative, or
m. a fiduciary.

3. No Legal Advice

Apostille MA Service does not provide legal advice.

No statement on our website, order form, email, text message, invoice, phone call, consultation, status update, or document review shall be treated as legal advice, legal opinion, immigration advice, foreign law advice, or a guarantee of legal acceptance.

You are responsible for speaking with your own attorney, immigration professional, school, employer, receiving party, foreign authority, embassy, consulate, or government office if you need legal guidance or confirmation of legal requirements.

4. No Immigration Advice

Apostille MA Service does not provide immigration advice.

We do not decide what documents are required for a visa, residency, citizenship, marriage, adoption, school enrollment, employment, business registration, court filing, or foreign proceeding.

You are responsible for confirming all requirements with the requesting party before placing an order.

5. No Foreign Law Advice

Apostille MA Service does not research, interpret, apply, or guarantee compliance with foreign law.

Destination country rules can differ by country, agency, region, institution, and document type. You are responsible for confirming all destination country requirements before submitting documents.

6. No Guarantee of Apostille, Authentication, Legalization, or Acceptance

Apostille MA Service does not guarantee:

a. that an apostille will be issued,
b. that an authentication will be issued,
c. that an embassy or consulate will legalize a document,
d. that a foreign country will accept a document,
e. that a school will accept a document,
f. that an employer will accept a document,
g. that a court will accept a document,
h. that an immigration office will accept a document,
i. that a receiving party will accept a document,
j. that a rush request will be completed by any specific date, or
k. that a document is legally sufficient for your intended use.

All final decisions are made by the government office, foreign authority, embassy, consulate, court, school, employer, agency, or receiving party.

7. Government and Third-Party Control

You agree that Apostille MA Service has no control over government offices, foreign authorities, embassies, consulates, couriers, shipping carriers, translators, schools, courts, employers, or other third parties.

We are not responsible for delays, closures, staff shortages, policy changes, rejection decisions, mail delays, system outages, appointment shortages, weather issues, customs delays, strikes, carrier mistakes, or other third-party conduct.

8. Notary and Apostille Rules

Some documents must be notarized or certified before they can be submitted for apostille or authentication.

Massachusetts notary law is governed in part by M.G.L. c. 222, and the Massachusetts notary materials you attached list M.G.L. c. 222, Section 15 for notarial acts and certificate forms. The same materials also identify apostilles and certification of documents as a separate process handled through the Massachusetts Secretary of the Commonwealth.

If a document is improperly notarized, missing required wording, missing a seal, signed incorrectly, issued by the wrong office, expired, incomplete, altered, or not eligible for apostille, it may be rejected.

You are responsible for providing documents that are complete, proper, and ready for submission.

9. Basic Review Is Not a Legal Review

Apostille MA Service may perform a basic administrative review of your documents.

This review is limited to checking visible submission issues, such as whether the document appears to have a signature, seal, notarization, certificate, or other visible requirement.

This review is not a legal review. It is not a guarantee that the document is valid, complete, eligible, enforceable, or acceptable to any receiving party.

10. Client Responsibility for Documents

You agree that you are fully responsible for:

a. choosing the correct document,
b. submitting the correct version,
c. confirming the destination country,
d. confirming the receiving party’s instructions,
e. confirming whether a translation is required,
f. confirming whether embassy legalization is required,
g. confirming whether state or federal processing is required,
h. confirming whether an original or certified copy is required,
i. confirming whether notarization is required,
j. confirming whether special wording is required, and
k. checking names, dates, spelling, seals, signatures, pages, and document contents before submission.

11. Authorization to Handle Documents

By placing an order, uploading documents, mailing documents, dropping off documents, or making payment, you authorize Apostille MA Service and its owners, employees, contractors, agents, couriers, vendors, and service providers to:

a. receive your documents,
b. inspect your documents for administrative processing,
c. scan or copy your documents when needed,
d. transport your documents,
e. submit your documents,
f. retrieve your documents,
g. pay approved third-party fees,
h. communicate with government offices or third parties about your order,
i. ship or mail your documents, and
j. take reasonable steps needed to complete the requested service.

The Client expressly authorizes Apostille MA Service to prepare, present, submit, file, retrieve, follow up on, mail, ship, and process the Client’s apostille, authentication, certification, legalization, vital record, certified copy, courier, shipping, and related document requests with the proper government office, secretary of state office, federal agency, embassy, consulate, courier, vendor, or third-party provider for the service selected by the Client.

This authorization is limited to the service you requested.

12. Online Orders and Electronic Acceptance

You agree that electronic acceptance is valid.

Checking an acknowledgment box, submitting an online order, uploading documents, making payment, or sending written approval by email or text shall act as your electronic signature and acceptance of these terms.

Apostille MA Service may keep electronic records, including order details, date, time, payment record, IP address, uploaded files, email records, text records, and checkbox acceptance records.

13. Pricing and Fee Disclosure

Apostille MA Service will disclose service fees before payment when reasonably possible.

Some fees may be charged separately if they are not known at the time of order, including:

a. government fees,
b. courier fees,
c. shipping fees,
d. embassy fees,
e. consulate fees,
f. translation fees,
g. notarization fees,
h. certified copy fees,
i. resubmission fees,
j. correction fees, and
k. special handling fees.

We will not treat optional fees as mandatory unless they are required for the service you selected or approved.

This clause is intended to keep pricing clear and avoid unfair or deceptive fee practices under Massachusetts consumer protection law. The Massachusetts consumer protection materials you attached state that 940 CMR 38.00 concerns unfair and deceptive fees and upfront fee disclosure.

14. Payment Authorization

By entering payment information or paying an invoice, you authorize Apostille MA Service or its payment processor to charge you for the service selected and any approved additional fees.

Work may not begin until payment is received unless Apostille MA Service agrees otherwise in writing.

Documents may be held until all balances are paid.

15. When Work Begins

For refund and cancellation purposes, work begins when Apostille MA Service takes any action on your order, including:

a. reviewing your intake form,
b. reviewing uploaded documents,
c. reviewing emailed documents,
d. answering order-specific processing questions,
e. preparing your order,
f. preparing a submission packet,
g. preparing an invoice,
h. creating a shipping label,
i. scheduling courier service,
j. contacting a third party about your order,
k. submitting documents,
l. paying a third-party fee, or
m. performing any administrative work related to your order.

16. Refund Policy

All fees are non-refundable once work begins, except where required by law or where Apostille MA Service agrees in writing to issue a refund.

Government fees, filing fees, courier fees, shipping fees, embassy fees, consulate fees, translation fees, notarization fees, certified copy fees, pickup fees, delivery fees, payment processing fees, and other third-party fees are non-refundable once incurred.

No refund is owed because:

a. a document is rejected,
b. a document is delayed,
c. an apostille is not issued,
d. an authentication is not issued,
e. a receiving party refuses the document,
f. the destination country changes its requirements,
g. the client submitted the wrong document,
h. the client gave incomplete instructions,
i. the client no longer needs the service,
j. the client missed a deadline,
k. the client found a lower price elsewhere, or
l. a third party caused the delay or rejection.

Nothing in this section waives any right that cannot be waived under Massachusetts law.

17. Rush, Same-Day, Expedited, and Estimated Processing

All processing times are estimates only.

Words such as “rush,” “same-day,” “next-day,” “urgent,” “expedited,” “priority,” “3 to 4 business days,” or similar phrases describe the requested handling level. They do not create a guarantee unless Apostille MA Service gives a separate written guarantee signed by an authorized company representative.

Apostille MA Service is not responsible for missed travel, missed flights, visa issues, immigration deadlines, school deadlines, business deadlines, court deadlines, wedding deadlines, adoption deadlines, citizenship deadlines, residency deadlines, job deadlines, financial loss, emotional distress, or other harm caused by processing time.

18. Rejections, Corrections, and Resubmissions

If a document is rejected, returned, delayed, or requires correction, you are responsible for all additional costs.

These costs may include:

a. new service fees,
b. government fees,
c. filing fees,
d. courier fees,
e. shipping fees,
f. notarization fees,
g. translation fees,
h. embassy fees,
i. consulate fees,
j. certified copy fees, and
k. administrative fees.

Apostille MA Service may assist with resubmission, but that does not mean Apostille MA Service accepts fault for the rejection.

19. Shipping, Mailing, and Courier Risk

You agree that USPS, FedEx, UPS, DHL, local couriers, international couriers, and other delivery providers are third parties.

Apostille MA Service is not responsible for packages that are lost, stolen, delayed, damaged, misdelivered, returned, held by customs, refused, or delivered to an incorrect address supplied by you.

You are responsible for giving a correct and complete delivery address.

You may request insurance, tracking, direct signature, overnight delivery, or special handling at additional cost. If you decline insurance or special handling, you accept the added risk.

20. Original Document Risk

By submitting original documents, you accept the risk that government offices, foreign authorities, embassies, consulates, couriers, or other third parties may staple, stamp, mark, fold, attach certificates to, retain, delay, damage, reject, or return the documents.

Apostille MA Service will use reasonable care while documents are in its direct possession. We are not responsible for third-party handling or normal apostille, authentication, or legalization markings.

21. Document Value Limitation

You understand that your documents may have personal, legal, financial, emotional, immigration, academic, or business value.

Unless Apostille MA Service agrees in writing before accepting the document, we do not accept responsibility for special, sentimental, legal, immigration, business, or consequential value.

If a document is lost or damaged while in Apostille MA Service’s direct possession due to ordinary negligence, the maximum liability shall be limited to the lesser of:

a. the amount paid to Apostille MA Service for the specific order, or
b. the direct replacement fee charged by the issuing authority for a replacement document.

This limit does not apply to intentional misconduct, fraud, or any claim that cannot be limited under Massachusetts law.

22. Limitation of Liability

To the fullest extent allowed by Massachusetts law, Apostille MA Service’s total liability for any claim shall not exceed the amount paid directly to Apostille MA Service for the specific order giving rise to the claim.

Apostille MA Service shall not be liable for:

a. indirect damages,
b. incidental damages,
c. special damages,
d. consequential damages,
e. punitive damages,
f. lost income,
g. lost profits,
h. lost business opportunity,
i. missed travel,
j. missed deadlines,
k. immigration consequences,
l. school consequences,
m. employment consequences,
n. court consequences,
o. foreign rejection,
p. emotional distress,
q. reputational harm,
r. third-party mistakes, or
s. courier delays or loss.

This limitation does not apply to intentional misconduct, fraud, willful misconduct, or any liability that cannot be limited under Massachusetts law.

23. Release of Claims

To the fullest extent allowed by law, you release Apostille MA Service, Ansspvt LLC, its owners, managers, members, employees, contractors, agents, vendors, couriers, affiliates, and service providers from claims arising from:

a. document rejection,
b. government delay,
c. foreign authority delay,
d. third-party delay,
e. courier delay,
f. courier loss,
g. customs delay,
h. wrong or incomplete client instructions,
i. wrong destination country information,
j. defective documents,
k. incomplete documents,
l. improper notarization by another notary,
m. receiving-party refusal,
n. client cancellation after work begins, or
o. use or misuse of processed documents.

This release does not apply to fraud, intentional misconduct, gross negligence, or claims that cannot be released under Massachusetts law.

24. Indemnification

You agree to defend, indemnify, and hold harmless Apostille MA Service, Ansspvt LLC, its owners, managers, members, employees, contractors, agents, vendors, couriers, affiliates, and service providers from any claim, demand, loss, damage, charge, penalty, fine, cost, expense, or attorney’s fee arising from:

a. false information you provide,
b. incomplete information you provide,
c. incorrect documents you submit,
d. altered, fraudulent, or improper documents,
e. lack of authority to submit documents,
f. failure to confirm destination requirements,
g. failure to disclose receiving-party instructions,
h. misuse of any apostilled or authenticated document,
i. disputes with a receiving party,
j. disputes with a third party, or
k. your breach of these terms.

25. No Waiver of Non-Waivable Rights

Nothing in these terms waives any right that cannot be waived under Massachusetts law, including non-waivable consumer rights under M.G.L. c. 93A.

However, you agree that all lawful limitations of liability, refund terms, shipping risk terms, third-party risk terms, release terms, indemnity terms, and document responsibility terms shall be enforced to the fullest extent allowed by law.

This section is important. If a waiver tries to waive everything, it can look unfair. This version protects the company while still saying non-waivable rights remain.

26. No Attorney-Client Relationship

No attorney-client relationship is created by using this website, placing an order, asking questions, uploading documents, paying an invoice, or receiving services.

Apostille MA Service does not represent you in any legal, immigration, court, government, foreign, business, school, or personal matter.

27. No Fiduciary Relationship

No fiduciary, trustee, legal representative, financial advisor, or special relationship is created.

The relationship is a limited private administrative service relationship only.

28. Translation Services and Vendor Services

If Apostille MA Service helps coordinate translation, courier, shipping, embassy, consulate, or vendor services, those services may be performed by third parties.

Apostille MA Service does not guarantee third-party performance, translation acceptance, translation accuracy, embassy acceptance, consulate acceptance, or receiving-party acceptance.

You must review all translations, spellings, names, dates, numbers, and document details before using them.

29. Privacy and Document Sharing

Apostille MA Service will use reasonable care when handling personal information and documents.

You authorize us to share documents and personal information with government offices, couriers, shipping carriers, embassies, consulates, translators, vendors, payment processors, contractors, and other parties as needed to complete the requested service.

30. Abandoned Documents

If you fail to respond, fail to pay, fail to provide instructions, fail to pick up documents, or fail to provide a valid return address within 60 days after notice, Apostille MA Service may treat the documents as abandoned.

Apostille MA Service may charge storage, handling, mailing, shipping, administrative, and retrieval fees for abandoned documents.

31. Chargebacks and Payment Disputes

You agree not to file a false or improper chargeback after work has begun or services have been performed.

If you file a chargeback after authorizing service, you remain responsible for:

a. unpaid service fees,
b. government fees,
c. courier fees,
d. shipping fees,
e. vendor fees,
f. chargeback fees,
g. collection costs, and
h. reasonable attorney’s fees and costs, where allowed by law.

Nothing in this section prevents you from raising a good-faith billing dispute.

32. Right to Refuse or Stop Service

Apostille MA Service may refuse, pause, or stop service if:

a. payment is not made,
b. information is incomplete,
c. documents appear altered, improper, suspicious, or unlawful,
d. the request appears fraudulent,
e. the request requires legal advice,
f. the request may violate law or policy,
g. the client is abusive, threatening, or dishonest,
h. a third party refuses service, or
i. a government office rejects or delays processing.

If service is stopped after work begins, refund rights are controlled by these terms and the posted refund policy.

33. Force Majeure

Apostille MA Service is not responsible for delay or failure caused by events outside its reasonable control, including:

a. government closure,
b. government delay,
c. weather,
d. natural disaster,
e. war,
f. civil unrest,
g. strike,
h. labor shortage,
i. pandemic,
j. public emergency,
k. system outage,
l. payment processor outage,
m. carrier delay,
n. customs delay,
o. embassy or consulate closure, or
p. any other event outside reasonable control.

34. Website Information

Website content is provided for general information only.

Apostille MA Service may update service descriptions, prices, timelines, policies, and requirements at any time.

If there is a conflict between website general information and these terms, these terms control unless Apostille MA Service gives a written exception.

35. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts.

36. Venue

Any dispute arising from these terms or services provided by Apostille MA Service shall be brought in a court of proper jurisdiction in Middlesex County, Massachusetts, unless another venue is required by law.

You agree to personal jurisdiction and venue in Massachusetts to the fullest extent allowed by law.

37. Severability

If any part of these terms is found invalid, unlawful, or unenforceable, the remaining sections shall remain in full force.

Any invalid section shall be limited or revised only as needed to make it enforceable.

38. Entire Agreement

These terms, together with the Privacy Policy, Refund Policy, posted service terms, order form disclosures, invoice terms, and written service instructions, form the entire agreement between you and Apostille MA Service for the service requested.

These terms replace any prior oral or written statement that conflicts with them.
